Scope of application
These conditions apply to online sales contracts concluded by HAPPY FRIZZ S.R.L., (hereinafter “the Company”), via the web platform www.happyfrizz.it, with a public of consumers (“the Customer”), i.e. natural persons who purchase the products exclusively for personal use and not for business or professional purposes.

Acceptance of the Conditions
These general terms and conditions of sale must be examined by the Customer before completing the product purchase procedure. It is understood that placing a purchase order via the web platform implies full knowledge and acceptance of these general sales conditions.

Product information and pricing
The products marketed are described according to current legislation and illustrated in their composition, properties and functionality. Product prices are in euros and include VAT. Prices do not include shipping costs, which will be calculated and indicated separately, prior to order confirmation.

Purchasing Procedure
Purchase is made by completing the order form available online. After completing the order form and before sending it, the Customer will receive a summary containing: order data, amount, shipping costs, place and time of delivery; it will be possible at this stage to correct any errors. After the order form has been sent, the Company shall send a confirmation of receipt of the order, which shall complete the contract. It is the Customer's responsibility to file or print a copy of these conditions and the order confirmation received. Pursuant to Article 12 of Legislative Decree 70/2003, each order shall be archived in electronic format on secure servers and in paper or digital format at the Company's premises.

Payment Methods
The following payment methods are accepted:

Credit Card (Visa, Mastercard - no American Express): payment is made via secure connection with the bank provider;
PayPal: the customer is redirected to the PayPal site to make the payment using his or her own credentials;
Bank transfer.

Sending the order form implies a commitment to pay the amount due. The total amount of the order is committed to the Customer's credit card or PayPal account at the time the order is placed; the charge is only made at the time of shipment.

Shipping and Delivery
Product deliveries are made exclusively on Italian territory, on weekdays and during working hours. Products will be shipped to the address provided by the Customer by courier. Delivery times, expressed in working days and starting from the confirmation of payment, are indicative. However, shipment will be guaranteed within 30 days of the order. If a product is not available, the Customer will be notified by e-mail with the possibility of changing or cancelling the order. Upon delivery, the Customer is required to check the integrity of the package. Any anomalies must be reported immediately to the courier.

Warranty and Service
The products sold comply with European regulations and standards. The conformity guarantee for the products sold is provided in accordance with the regulations contained in Legislative Decree no. 206/2005 (Consumer Code). The Company provides the official guarantee for the duration of 24 months from the date of delivery. To enforce the guarantee, the Customer must report the conformity defect by attaching:

The Company shall contact the Customer to agree on the arrangements for the return and delivery of the product. The Company undertakes to repair or replace the defective product free of charge. Alternatively, if the previous options are not feasible, the Customer may request a price reduction or termination of the contract. The Customer does not have the right to terminate the contract if the conformity defect is only minor; the burden of proof of the slightness of the defect is on the seller. The guarantee does not cover damage resulting from misuse, negligence or tampering.

Limitations of Liability
The Company shall not be liable for delays or failures due to fortuitous events or force majeure, including Internet failures. In the event of non-execution of the order for reasons not attributable to the Company, the amount paid shall be refunded.

Applicable Law and Jurisdiction
These general terms and conditions are governed by Italian law. For disputes arising from the interpretation, validity and/or execution of these general terms and conditions and the business relationship between the parties, the court of the place of residence of the consumer customer shall have exclusive jurisdiction.

Privacy and data protection provisions
The collection and processing of data are carried out for the management and execution of purchase orders and in particular for the execution of obligations arising from these General Terms and Conditions of Sale. A copy of the Privacy Policy can be found in the appropriate section on the web platform www.happyfrizz.it. The placing of a purchase order through the web platform implies full knowledge and acceptance of the Privacy Policy on the aforementioned website.
